Le chocolat est l’un des aliments pr\u00e9f\u00e9r\u00e9s des Fran\u00e7ais. Et pourtant, il est souvent rel\u00e9gu\u00e9 au rang de simple gourmandise, sans que l’on imagine les obstacles et les contraintes juridiques surmont\u00e9s avant de rejoindre les placards de nos foyers. Des for\u00eats tropicales aux cuisines occidentales, le chocolat est soumis \u00e0 une r\u00e9glementation riche qui impacte toutes les \u00e9tapes de sa culture, sa fabrication, sa commercialisation, et sa consommation.
Qualit\u00e9 du produit, d\u00e9finition du chocolat, protection de la sant\u00e9, propri\u00e9t\u00e9 intellectuelle, publicit\u00e9 et repr\u00e9sentation du chocolat, fiscalit\u00e9 dans les pays consommateurs, finances publiques dans les pays producteurs, protection des for\u00eats, travailleurs et peuples autochtones ou encore d\u00e9veloppement durable sont autant de sujets qui ont conduit \u00e0 ce que le chocolat soit lui aussi \u00a0\u00bb croqu\u00e9 \u00a0\u00bb par le droit.
Cet ouvrage, unique en la mati\u00e8re, permet ainsi de faire d\u00e9couvrir le droit applicable au chocolat, tout comme les enjeux et les questions de soci\u00e9t\u00e9 qui lui sont inextricablement li\u00e9s. Le cacao et le chocolat ne sont pas des objets d’\u00e9tude habituels des juristes et ne sont nullement envisag\u00e9s comme tels par les consommateurs, ce qui est bien normal. Pourtant, derri\u00e8re le chocolat, qui se trouve sous des formes vari\u00e9es dans tous les foyers, de nombreuses questions juridiques existent, car le chocolat est en r\u00e9alit\u00e9 largement appr\u00e9hend\u00e9 par la norme juridique ; notamment en ce qui concerne la qualit\u00e9 du produit et sa d\u00e9finition, la protection de la sant\u00e9, la propri\u00e9t\u00e9 intellectuelle, la publicit\u00e9 et la repr\u00e9sentation du chocolat, la fiscalit\u00e9 dans les pays consommateurs ou encore les finances publiques dans les pays producteurs.
D\u00e9couvrir le droit applicable au chocolat, c’est d\u00e9couvrir tout un univers insoup\u00e7onn\u00e9 et souvent voir d’un oeil nouveau des approches largement admises. En outre, loin des placards des cuisines occidentales, la culture du cacao, produit phare de la mondialisation, n\u00e9cessite une r\u00e9elle r\u00e9flexion et un encadrement juridiques pour prot\u00e9ger les for\u00eats, les travailleurs, les peuples autochtones et ainsi garantir le d\u00e9veloppement durable.
