R\u00e9gie par l\u2019arr\u00eat\u00e9 du 25 mai 2016<\/a> modifi\u00e9 par l’arr\u00eat\u00e9 du 26 ao\u00fbt 2022, la diffusion des th\u00e8ses de doctorat doit r\u00e9pondre \u00e0 certaines obligations. Elle comporte \u00e9galement des enjeux d\u2019importance que le doctorant doit prendre en compte : visibilit\u00e9 de son travail de recherche, valorisation de l\u2019institution, participation \u00e0 la science ouverte, respect du droit d\u2019auteur, etc.<\/p>\n

La diffusion de la version compl\u00e8te de la th\u00e8se telle que valid\u00e9e par le jury de soutenance est obligatoire \u201cau sein de l\u2019ensemble de la communaut\u00e9 universitaire\u201d<\/strong>, exception faite des th\u00e8ses pr\u00e9sentant \u201cun caract\u00e8re de confidentialit\u00e9 av\u00e9r\u00e9\u201d.<\/strong><\/p>\n

Si vous souhaitez publier votre recherche sous forme d’article ou de livre dans une revue ou chez un \u00e9diteur, vous d\u00e9sirez faire une demande d’embargo<\/a> et non de confidentialit\u00e9.<\/p>\n

Si votre th\u00e8se doit \u00eatre d\u00e9clar\u00e9e confidentielle, une demande sp\u00e9cifique<\/strong> doit \u00eatre faite d\u00e8s que le caract\u00e8re confidentiel doit \u00eatre obtenu et au minimum 3 mois avant la date de soutenance<\/strong> par le doctorant et son directeur de th\u00e8se aupr\u00e8s de l\u2019\u00c9cole Doctorale d’inscription, en m\u00eame temps que le d\u00e9but de la proc\u00e9dure de soutenance<\/a><\/p>\n

Si la demande de confidentialit\u00e9 s\u2019accompagne d\u2019une demande de soutenance \u00e0 huis clos<\/strong>, la validation est alors soumise \u00e0 l\u2019accord de la Pr\u00e9sidente de l\u2019universit\u00e9<\/strong>.
Si elle n\u2019est pas accompagn\u00e9e d\u2019une demande de soutenance \u00e0 huis clos, la demande est valid\u00e9e par le directeur de l\u2019ED<\/strong>.<\/p>\n

Le secret d\u00e9fense est \u00e9dict\u00e9 par un officier de s\u00e9curit\u00e9 et non par le doctorant.
Les th\u00e8ses class\u00e9es secret d\u00e9fense font l\u2019objet d\u2019une proc\u00e9dure sp\u00e9cifique.<\/p>\n

La confidentialit\u00e9 est limit\u00e9e dans le temps<\/strong>. La dur\u00e9e maximale<\/strong> de celle-ci d\u00e9pend du motif de confidentialit\u00e9<\/strong> et est \u00e9dict\u00e9e par le Code du Patrimoine, article L213-2<\/a>.<\/p>\n

Exemple : concernant le secret industriel et commercial<\/strong>, la dur\u00e9e maximale de confidentialit\u00e9 est de 25 ans<\/strong>.<\/p>\n

Pour qu’une th\u00e8se soit d\u00e9clar\u00e9e confidentielle, une demande sp\u00e9cifique<\/strong> doit \u00eatre faite au minimum 3 mois avant la soutenance<\/strong> par le doctorant et son directeur de th\u00e8se et adress\u00e9e \u00e0 l\u2019\u00c9cole Doctorale.<\/p>\n

La demande peut \u00eatre formul\u00e9e par mail et doit imp\u00e9rativement contenir un argumentaire sur le caract\u00e8re confidentiel<\/strong> de la th\u00e8se soutenue.<\/p>\n

Deux cas de figures:<\/strong><\/p>\n

1. La demande concerne une confidentialit\u00e9 sans soutenance \u00e0 huis-clos<\/strong>: la demande est valid\u00e9e par la direction de l’ED
2. La demande de confidentialit\u00e9 est accompagn\u00e9e d’une demande de soutenance \u00e0 huis-clos<\/strong>: la validation de la demande est alors soumise \u00e0 l’accord de la Pr\u00e9sidence de l’universit\u00e9.<\/p>\n

Votre demande de confidentialit\u00e9 est remont\u00e9e par l’ED au Bureau des soutenances du CED, pour enregistrement.<\/p>\n

La soutenance \u00e0 huis-clos (soutenance sans public) peut \u00eatre demand\u00e9e quand un financeur l’exige, quand aucune donn\u00e9e de la th\u00e8se ne peut \u00eatre omise lors de la soutenance de th\u00e8se…<\/p>\n

Avant de transmettre le manuscrit aux rapporteurs, ces derniers doivent retourner un accord de confidentialit\u00e9 sign\u00e9 et accompagn\u00e9 d’une pi\u00e8ce d’identit\u00e9. Ce n’est qu’une fois les accords de confidentialit\u00e9 re\u00e7us que le doctorant est invit\u00e9 \u00e0 transmettre son manuscrit.
Il en est de m\u00eame pour les autres membres du jury, une fois la soutenance autoris\u00e9e.<\/p>\n

Le d\u00e9p\u00f4t de la version compl\u00e8te de la th\u00e8se, le signalement et l\u2019archivage sont obligatoires pour les th\u00e8ses confidentielles<\/strong>.<\/p>\n

Le signalement des th\u00e8ses confidentielles comprend obligatoirement le titre, les mots-cl\u00e9s, les r\u00e9sum\u00e9s en fran\u00e7ais et en anglais de la th\u00e8se ainsi que les membres du jury<\/strong>. Ce signalement appara\u00eet en libre acc\u00e8s<\/strong> sur les site Th\u00e8ses.fr<\/a>, le Sudoc<\/a> et le catalogue des biblioth\u00e8ques Universit\u00e9 Paris Cit\u00e9<\/a>.<\/p>\n

Pour les th\u00e8ses confidentielles dans le cadre d’une d\u00e9marche de protection de la propri\u00e9t\u00e9 intellectuelle (brevets…), il conviendra de r\u00e9diger un r\u00e9sume de la th\u00e8se qui ne d\u00e9voile aucune information sensible ou valorisable. Se r\u00e9f\u00e9rer \u00e0 la partie \u00ab\u00a0Confidentialit\u00e9 pour protection de la PI\u00a0\u00bb.<\/p>\n

Le texte int\u00e9gral de la th\u00e8se confidentielle n\u2019est en aucun cas diffus\u00e9 pendant la dur\u00e9e de la confidentialit\u00e9<\/strong>. Ni en acc\u00e8s libre, ni en acc\u00e8s restreint.
La dur\u00e9e de la confidentialit\u00e9 est variable et peut s\u2019\u00e9tendre sur plusieurs d\u00e9cennies. La th\u00e8se n\u2019est pas diffus\u00e9e sur internet\u2026 et n\u2019est pas accessible \u00e0 la communaut\u00e9 universitaire pendant la dur\u00e9e de la confidentialit\u00e9 – \u00e0 la diff\u00e9rence de l’embargo.<\/a><\/p>\n
